Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your use of the HostMonitor application ("the App"), a network monitoring utility for Windows distributed through the Microsoft Store. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.
2. License
Subject to your compliance with these Terms, the developer grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, in accordance with the usage rules of the Microsoft Store.
You may not:
- Reverse engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law.
- Rent, lease, lend, sell, redistribute, or sublicense the App.
- Remove or alter any proprietary notices on the App or its documentation.
- Use the App for any unlawful purpose or in violation of these Terms.
3. Acceptable Use
The App is intended for monitoring hosts and services that you own or have explicit authorization to probe. You are solely responsible for ensuring you have the right to send network probes to any host you configure. The developer is not responsible for misuse of the App, including but not limited to unauthorized scanning of third-party systems.
4. No Warranty
The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. The developer does not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.
You acknowledge that network monitoring tools are subject to inherent limitations and may produce false positives, false negatives, or inaccurate results. The App should not be relied upon as the sole means of monitoring critical infrastructure.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the App, even if advised of the possibility of such damages.
The developer's total cumulative liability under these Terms shall not exceed the amount you paid for the App, if any, in the twelve months preceding the claim.
6. Updates
The App may receive updates through the Microsoft Store. These updates may add, modify, or remove features. Continued use of the App after an update constitutes acceptance of any changes.
7. Termination
These Terms remain in effect until terminated. You may terminate them at any time by uninstalling the App. The developer may terminate or suspend your license if you materially breach these Terms. Upon termination, you must cease all use of the App and uninstall it.
8. Distribution and Payment
The App is distributed as a free trial through the Microsoft Store and is subject to Microsoft's Store Policies and Standard Application License Terms with respect to distribution. In the event of a conflict between these Terms and Microsoft's terms regarding distribution, the relevant Microsoft terms shall govern that subject matter.
Paid licenses for the App are sold through Paddle.com Market Limited ("Paddle"), which acts as the merchant of record and authorized reseller. Paddle handles checkout, payment processing, tax collection and remittance, and refund processing on behalf of the developer. Your purchase of a license is also subject to Paddle's Checkout Buyer Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of that jurisdiction, except where mandatory consumer protection laws of your country of residence apply.
10. Changes to These Terms
The developer may revise these Terms from time to time. The current version will always be posted at this URL with a revised "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.
